1. Purpose

This Digital Consent Policy explains how Nex-Trends LLC collects, records, and manages consent from individuals who interact with our digital services, AI-powered tools, automated systems, and marketing communications. We are committed to transparent, lawful, and respectful engagement with every person who contacts us or uses our platform.

2. Who This Policy Applies To

This policy applies to all individuals who:

  • Submit a form, quiz, or survey on any Nex-Trends website or landing page
  • Interact with our AI voice agent (Nex) by phone or web widget
  • Provide their contact information through any Nex-Trends digital channel
  • Opt in to receive SMS, email, or other communications from Nex-Trends LLC
  • Book an appointment, request a callback, or initiate a discovery call
  • Are added to a GoHighLevel CRM pipeline or automated workflow

3. Types of Consent We Collect

3.1 — SMS Consent

Before enrolling any individual in SMS marketing or automated text workflows, Nex-Trends obtains express written consent. This may be collected through a website form checkbox, a verbal confirmation captured during an AI or human call, a keyword opt-in via text message, or a quiz or landing page submission that includes clear SMS consent language. Consent is logged with a timestamp, source, and the consent language presented at the time of collection.

3.2 — Email Consent

By submitting their email address through any Nex-Trends form, landing page, or quiz, individuals consent to receive relevant email communications including follow-ups, service information, and marketing content. Each email includes an unsubscribe link. Consent is recorded in our GoHighLevel CRM at the point of capture.

3.3 — AI Voice Agent Consent

When individuals interact with Nex — our AI voice agent — they are informed at the beginning of the interaction that they are speaking with an AI system. By continuing the conversation, the individual consents to the interaction being processed by our AI platform. Any contact information provided during the call is captured and stored in our GHL CRM under the terms of this policy and our Privacy Policy.

3.4 — Appointment and Callback Consent

By booking an appointment, requesting a callback, or submitting contact information for the purpose of follow-up, individuals consent to be contacted by Nex-Trends LLC via the channel they selected — phone, SMS, or email — for the purpose of that engagement.

3.5 — Cookie and Tracking Consent

Our websites may use cookies, pixels, and similar tracking technologies to improve user experience and measure marketing performance. Where required by law, we present a cookie consent notice upon first visit. Continued use of our website after notice constitutes consent to non-essential tracking unless you opt out through your browser settings.

3.6 — Recording Consent

Calls handled by our AI voice agent or team members may be recorded for quality assurance, training, and service improvement purposes. Where required by law, callers are notified of recording at the start of the call. By continuing the call, the individual consents to being recorded.

4. How Consent Is Recorded

All consent events are logged within our GoHighLevel CRM system and include the following where technically available:

  • Date and time of consent
  • Channel through which consent was given (form, call, quiz, SMS keyword, etc.)
  • The specific consent language or disclosure presented to the individual
  • The phone number, email address, or identifier associated with the consent event
  • The workflow or communication type the individual consented to receive

5. Consent Language Standards

All Nex-Trends forms, landing pages, and opt-in points that collect contact information for marketing or communication purposes include clear disclosure language. Standard language used is:

"By submitting this form, you agree to receive SMS and email communications from Nex-Trends LLC. Message and data rates may apply. You may opt out at any time by replying STOP to any SMS or clicking unsubscribe in any email. Your information will not be sold or shared with third parties for marketing purposes."

Consent is never implied, pre-checked, or bundled as a condition of service unless it is strictly necessary to deliver the service requested.

6. Withdrawing Consent

Individuals may withdraw consent at any time through any of the following methods:

  • SMS: Reply STOP to any message — removal is immediate and automatic
  • Email: Click the unsubscribe link in any email — removal is processed within 10 business days
  • Phone: Call or text 971-260-7929 to request removal
  • Email request: Send a written request to [email protected]
  • AI Agent: Inform Nex during any call that you wish to be removed — the request is flagged for immediate processing

Upon withdrawal, Nex-Trends will cease all non-essential communications through the requested channel. A single confirmation message may be sent to acknowledge the opt-out.

7. Consent for Minors

Nex-Trends LLC does not knowingly collect consent or personal information from individuals under the age of 18. Our services are intended for business owners and professionals. If we become aware that a minor has provided consent or personal information, we will delete that information promptly.

8. Third-Party Consent Compliance

When Nex-Trends operates AI agents, SMS campaigns, or email workflows on behalf of client businesses, those clients are responsible for ensuring that their own customers have provided appropriate consent before being contacted through Nex-Trends-managed systems. Nex-Trends will not knowingly operate automated communications to individuals who have not consented.

9. Regulatory Compliance

This policy is designed to comply with applicable regulations including:

  • TCPA — Telephone Consumer Protection Act
  • CAN-SPAM Act — for commercial email communications
  • A2P 10DLC requirements — The Campaign Registry and carrier regulations
  • CCPA — California Consumer Privacy Act, where applicable
  • FTC guidelines — on endorsements, advertising, and digital marketing

10. Policy Updates

Nex-Trends LLC reserves the right to update this Digital Consent Policy at any time. Material changes will be reflected in the updated date at the top of this page. Continued use of our services or maintained consent after changes are posted constitutes acknowledgment of the revised policy.
