Terms and Conditions — Nex Trends LLC

1. Agreement to Terms

By accessing or using the website, services, or communications provided by Nex Trends LLC ("Nex-Trends," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. About Nex-Trends

3. Services

Nex-Trends provides revenue system activation and commissioning, including CRM workflow configuration, communication channels setup, lead response automation, estimate follow-up systems, and database reactivation tools. Service details, deliverables, and billing terms are outlined in individual plan agreements and proposals.

4. Intellectual Property

All content, system architectures, workflows, and marketing assets created or provided by Nex-Trends remain the intellectual property of Nex Trends LLC. Clients receive a license to use configured revenue systems during active subscription periods as outlined in their applicable service agreement. You may not reproduce, distribute, or resell our proprietary systems or processes without written permission.

5. Client Responsibilities

You agree to provide accurate business information necessary to commission services, respond to reasonable requests for feedback in a timely manner, and comply with all applicable laws in your business operations — including TCPA, SMS consent compliance, and local licensing requirements.

6. Payment & Usage Fees

Payment terms for monthly plans and Activation & Commissioning are specified in individual service agreements or invoices. Carrier, telephony, SMS, email, and metered AI provider usages are billed separately based on actual consumption where applicable. Nex-Trends reserves the right to pause services for non-payment.

7. Limitation of Liability

Nex Trends LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim. We do not guarantee specific revenue figures or conversion rates, as business outcomes depend on multiple external factors.

8. Third-Party Infrastructure

Our systems operate using underlying communications, carrier, and telephony infrastructure. Nex-Trends is not responsible for outages, carrier delivery failures, or policy updates made by third-party network providers that affect service delivery.

9. Termination

Either party may terminate a service agreement with written notice as specified in the applicable contract. Nex-Trends reserves the right to suspend or terminate services immediately for violation of these terms or non-compliant communication practices.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of Arizona. Any disputes shall be resolved in Maricopa County, Arizona.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
